By using Pilcrowa you accept these terms. Pilcrowa is a software service operated by Fosync, established in Canada.
Subscription and payment
Pilcrowa is a paid subscription service. New accounts receive a one-time allocation of 10 trial credits so you can evaluate the product before buying; these credits do not renew monthly, and once used you must choose a plan to continue.
Prices are in Canadian Dollars (CAD) and exclude tax. Any applicable sales tax is calculated at checkout based on your country and shown as a separate line on your invoice. Your billing period is anchored to the day your plan started; credits are topped back up to your plan's amount at the start of each period, and unused PLAN credits do not carry over. Purchased top-up credits are the exception: they are held in a separate balance, do not expire at the end of a period, and are spent after your plan credits run out.
Payments are collected by credit or debit card through Stripe Payments. By purchasing a plan you authorise us to charge your card the price of your plan (plus applicable tax) at the start of each period until you cancel. Your card details are stored by Stripe; Pilcrowa never sees or stores your card number.
Monthly plans renew every month and annual plans every year on the same calendar day. The renewal amount and date are shown on the Subscription page in your account; you can cancel at any time before renewal.
Plan upgrades take effect immediately and the new plan's credits are added to your account; the difference is prorated by the payment provider. Plan downgrades take effect at the end of the period you have paid for — your current plan's benefits continue unchanged until then.
Failed payments
If a renewal payment fails, generation features stop and your account is paused; the content you have produced remains accessible and exportable. The payment provider retries the charge a number of times. When you update your card from the management screen on the Subscription page, access is restored automatically. If the payment permanently fails, the subscription is terminated.
Before disputing a charge with your bank (a chargeback), please contact us first: if the refund conditions are met we will refund you directly. When a dispute is opened, the account may be suspended until it is resolved.
Refund policy
Within 7 days of your first payment, provided that no credits have been spent on your account, we will refund it in full. You can request a refund from the contact form. Once credits have been spent, the fee for that period is non-refundable; for this reason we recommend using your free trial credits before purchasing. This policy does not limit your rights under applicable consumer protection law.
Cancellation
You may cancel your subscription at any time; there is no commitment. Cancellation takes effect at the end of the period you have paid for: your account stays active and your credits remain usable until then, after which it simply does not renew. We recommend exporting your content before cancelling.
Content you produce
The text, headlines and images you generate with Pilcrowa are yours and may be used commercially. Stock photos remain subject to the provider's (Pexels) licence, and the required attribution is added to your exports automatically. You are responsible for the content you generate and publish; we recommend reviewing AI output for accuracy before publishing.
Acceptable use
You may not use the service to produce unlawful content, infringe others' rights, distribute misleading or deceptive content, or place excessive load on it through automated tools. We may suspend or close your account if these terms are breached.
Service availability
We make reasonable efforts to provide the service without interruption; however, maintenance, updates or third-party provider outages may occur. In the event of a prolonged outage we will provide proportionate compensation for the affected period, limited to the subscription fee for that period. Changes to pricing or plan contents will be announced at least 30 days in advance and will not affect your current period.
Limitation of liability
The service is provided as is. We make no warranty as to the accuracy, completeness or fitness for a particular purpose of AI output; reviewing content before publishing is your responsibility. To the extent permitted by law, the total liability of Pilcrowa and Fosync for any claim is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect damages, lost profits or lost data. These limitations do not affect non-waivable rights under applicable consumer protection law.
Governing law and jurisdiction
These terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. The courts of Ontario have jurisdiction over disputes. Rights granted to you as a consumer by the laws of your country of residence, which cannot be limited by contract, are unaffected. In case of a dispute we ask that you contact us first through the contact form; most matters are resolved at that stage.
